    I agree with Mr. Whedbee: The Commission should be obligated to take action on a Petition for Rulemaking within 180 days. Either start an NPRM (or at least an NOI), or dismiss the petition. But if it's dismissal, there should be a reasonable justification given.

    Sorry, I disagree. There needs to be a system of checks and balances. I have seen too many "scams" where a proponent claims that its scheme is "noncontroversial" and/or couldn't possibly cause interference to incumbent users. The best way to ensure that a back-door rulemaking by waiver doesn't happen is to let plenty of ECFS sunshine apply. If it's truly a technically valid proposal, full public exposure won't hurt it.

    Some commenters appear to believe that my proposal was that all FCC commissioners be engineers. No, it's only that at least one FCC commissioner have his or her own technical background. I would even settle for an FCC commissioner who is both an engineer and an attorney.
